FORT SHAFTER, Hawaii -- The U.S. Army Corps of Engineers (USACE) Pacific Ocean Division (POD) and the Appellant have received the administrative record from the USACE Alaska District as of May 26, 2021. The administrative record contains documents pertaining to the Pebble Mine permit decision, which will be considered by the Division Engineer when making a determination on the merits of the appeal.
Over the past decade, the national average for completion of a Regulatory appeal is approximately one year. The volume and complexity of the information to consider for this particular appeal far surpasses that of an average appeal. It is expected that the process will extend beyond the national average in order to allow for the time necessary to evaluate the merits of the appeal. The Pacific Ocean Division remains committed to maintaining an administrative appeal process that is independent, objective, fair, and efficient.
The USACE Administrative Appeals Process does not include a public comment period as this process is strictly limited to a review of the District’s administrative record. However, members of the media or public may submit inquiries to pod-pao@usace.army.mil.
